Welcome to cherryplot (“cherryplot,” “we,” “us”), a free, for-fun website operated by bypurr. By using cherryplot you agree to these Terms. If you do not agree, please don’t use the site.
1. What cherryplot is
cherryplot is a playful tool that suggests a real nearby place and a lighthearted “quest” for you to try. It is provided for entertainment only. It is not advice of any kind (including safety, health, legal, financial, or professional advice).
2. Who can use it
You must be at least 13 years old to use cherryplot. If you are under 18, you may only use it with the involvement and permission of a parent or guardian, who is responsible for your use.
3. Assumption of risk: please read
cherryplot encourages you to go out and do things in the real world. You are solely responsible for your own safety, decisions, and conduct. Use common sense, obey the law, respect others, and never do anything that puts you or anyone else at risk. Suggestions and quests are optional prompts, not instructions, so skip any you’re not comfortable with.
To the fullest extent permitted by law, you assume all risks arising from visiting any place or following any suggestion, and you release bypurr and cherryplot from any liability for injury, loss, or damage resulting from your use of the site or your real-world activities.
4. Accuracy of place information
Place data comes from third parties (including Google and OpenStreetMap) and may be incomplete, out of date, or wrong. A spot may be closed, private, or unsuitable. Verify details independently before you go. We don’t endorse or vouch for any place shown.
5. Accounts
Signing in is optional and passwordless (a one-time magic link sent to your email). You’re responsible for keeping access to your email secure, and for activity that happens under your account. We may suspend or remove accounts that abuse the service. You can sign out or request deletion at any time.
6. Your submissions
If you submit a quest, add a spot, or send a partner inquiry, you confirm the content is your own (or you have the right to share it) and that it is not unlawful, hateful, harassing, dangerous, deceptive, or infringing. You grant us a non-exclusive, royalty-free, worldwide license to use, display, edit, and remove it in connection with the service. We review submissions and may reject or remove anything at our discretion. Please don’t include sensitive personal information in a public suggestion.
7. Sponsored content
Some places may appear because a business paid to be featured. When they do, they are clearly labeled (for example, “partner pick”). Paid placement does not change our safety or quality expectations, and labeled sponsors are the only paid placements we run.
8. Acceptable use
Don’t misuse the site, attempt to disrupt or overwhelm it, scrape it at scale, bypass rate limits, or use it for anything unlawful.
9. No warranties
cherryplot is provided “as is” and “as available,” without warranties of any kind. We don’t promise it will be accurate, uninterrupted, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, bypurr and cherryplot will not be liable for any indirect, incidental, special, or consequential damages, or for any injury, loss, or damage arising from your use of the site or your real-world activities. Where liability can’t be excluded, it is limited to the amount you paid to use cherryplot (which is $0).
11. Indemnification
You agree to indemnify and hold bypurr and cherryplot harmless from any claims, losses, or expenses arising out of your use of the site, your real-world activities, your submissions, or your violation of these Terms, to the extent permitted by law.
12. Changes
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
